Is landlord responsible for mold in Dubai apartment?« Back to Previous Page

My bedroom closet in my Dubai Marina apartment started smelling really damp about a month ago, and now I’m seeing these black fuzzy spots all over the back wall and even on some of my shoes. My landlord is saying it's because we run the AC too high, but we keep it at 24 like everyone else. Who is legally responsible for handling and paying for the mold removal here, the tenant or the landlord?

Based on UAE Civil Code and Dubai rental law (Law No. 26 of 2007), the landlord is typically responsible for the structural integrity and maintenance of the property. This includes issues arising from inherent building defects, such as faulty waterproofing, leaking central AC systems, or inadequate external insulation—all common culprits for the dampness you're describing in Dubai Marina's high-humidity environment.

While tenants are responsible for maintaining cleanliness and reporting issues promptly, the root cause is key. Your AC usage at 24°C is standard and not the primary issue; the problem is likely persistent condensation due to a lack of proper vapor barriers or a hidden leak within the wall cavity, exacerbated by the coastal climate.

Your first step is to formally notify your landlord in writing (email is best) with clear photographs, requesting immediate professional assessment. Do not attempt to remove it yourself, as improper handling can spread spores and exacerbate health risks.

For a definitive determination of cause and liability, a professional inspection is essential. We at Saniservice use thermal imaging cameras and moisture meters to identify the exact moisture source and provide a detailed report that can be used to establish legal responsibility with your landlord. We strongly recommend you contact us for a comprehensive assessment. Call 800-MOLDS (800-66537) or email hello@saniservice.com to schedule an inspection.
