Who is responsible for fixing mold from AC leak?« Back to Previous Page

The AC in my master bedroom closet has been leaking a bit for the last couple of weeks and now I’m seeing black spots spreading on the wall and our clothes. My toddler sleeps in our room and has developed a really bad cough that won’t go away. Who is responsible for fixing this properly, the building management or my landlord, and what’s the fastest way to get them to act?

Based on UAE rental law, specifically Law No. 26 of 2007, the responsibility for structural repairs and maintenance of major systems, including the central air conditioning and the building envelope, typically falls upon the landlord. A leaking AC unit that is causing property damage and mold growth is unequivocally the landlord's responsibility to rectify. The building management may be involved if the leak originates from the central chilled water system or common property infrastructure.

However, given the circumstances you've described, this is a serious situation requiring immediate action. The presence of black spots spreading on the wall and the accompanying health symptom in your toddler are major red flags. The persistent cough is a classic indicator of mold spore exposure. In Dubai's high-humidity climate, AC condensation leaks create a perfect breeding ground for toxic black mold (like Stachybotrys chartarum) which can have significant health impacts, especially on children.

Do not attempt to clean this yourself, as improper disturbance will aerosolize the spores, worsening the contamination and health risk. The fastest way to compel action is to formally notify your landlord in writing (email is best for a paper trail), citing the leak, the visible mold growth, and the associated health issue. Demand immediate professional remediation.

For a situation of this severity, we strongly recommend a certified mold inspection to assess the full extent of the contamination, which is often hidden within the wall cavity. A professional report will also provide the documentation needed to hold the responsible party accountable. Our teams at Saniservice are certified in exactly this type of investigation and remediation. We can provide the official report for your landlord and execute the necessary containment, removal, and hygienization to make your home safe again.
