Is landlord responsible for mold from unrepaired AC leak?« Back to Previous Page

The AC in our bedroom closet has been leaking a little for a couple of months, and now we’ve discovered a huge patch of black mold growing on the back wall and our stored winter clothes. We told the building management about the leak but they were slow to fix it. Are we responsible for cleaning this mold and replacing our damaged belongings, or is it the landlord's duty?

In the UAE, particularly in Dubai's high-humidity climate where AC systems run year-round, condensation and leaks are a primary cause of mold growth. The responsibility for remediation and damages in a rental property is typically dictated by the tenancy contract and Dubai Law No. 26 of 2007, as amended (the Dubai Rental Law).
Generally, the landlord is responsible for maintaining the structural integrity of the property and all major installed systems, including the central air conditioning unit and its condensate drainage lines. If you have reported the AC leak to building management (who acts on behalf of the landlord) and they were negligent in repairing it in a timely manner, the resulting mold growth and damage to your personal property are likely their financial responsibility. The leak is the root cause, and the mold is a direct consequence of their failure to address it. However, you have a duty to mitigate further damage. Continuing to use a leaking unit and storing belongings in the affected area could be seen as contributory negligence. For a case of this magnitude ("a huge patch"), a professional inspection is critical. We need to determine the extent of the mold growth, including within the wall cavity and the AC system itself, which poses a cross-contamination risk. DIY cleaning is strongly discouraged for large infestations, as improper handling can aerosolize toxins and spread the problem. I recommend you formally document the issue with dated photos and your prior communications with management.
