Who pays for mold removal in a Dubai rental?« Back to Previous Page

Our bedroom closet on the outside wall has started to get these black splotches, and I’m worried it’s mold, especially with all the humidity lately. We’ve been in this Marina apartment for about a year and never had an issue until now. The landlord is saying it's our fault for not ventilating properly, but the AC is always on. Who is legally responsible for arranging and paying for the inspection and removal here in Dubai?

Based on the UAE Civil Code and standard Dubai rental contract (EJARI) provisions, the responsibility for mold remediation typically falls on the property owner (landlord). The law generally imposes a duty on the landlord to provide a habitable property that is free from structural defects and issues that affect the tenant's peaceful enjoyment.

The key factor is establishing the root cause. If the mold growth, like the black splotches you describe on an exterior wall, is due to a structural issue—such as water infiltration from a leaking pipe within the wall, faulty building sealants, or inadequate insulation—the landlord is unequivocally responsible for the repair and the ensuing mold removal.

However, if the cause is conclusively proven to be solely due to tenant negligence—for instance, a complete lack of ventilation, excessive indoor moisture generation without exhaust, or damage to the property that allowed moisture in—the tenant may be liable. Your point about constant AC use is critical; in Dubai's humid climate, air conditioning is the primary method of humidity control and dehumidification. Merely having it "on" may not be sufficient if the unit is undersized, faulty, or not set to an appropriate dehumidifying mode. Condensation can still occur on cold exterior walls, especially behind closets where airflow is restricted.

Given this ambiguity, a professional inspection is essential. We recommend you formally request the landlord to arrange a proper mold investigation to determine the exact cause. A certified inspector will identify the moisture source and type of mold, which dictates the legal and financial responsibility.
