Who is responsible for AC leak and black mold?« Back to Previous Page

The AC in my apartment seems to be constantly leaking, and now I've found a patch of black mold spreading on the wall behind the bedroom curtain in my Marina apartment. My landlord is saying it's due to how we use the AC, but we keep it at 24 degrees and the leak is clearly from the unit itself. Who is legally responsible for the cleanup and repairs in this situation?

Based on UAE tenancy law, specifically Law No. (26) of 2007, the landlord is generally responsible for maintaining the structural integrity of the property and its core systems, which includes the central air conditioning unit and its associated drainage. An AC leak is a maintenance issue stemming from a faulty installation, blocked drain line, or damaged condensate pan within the unit itself. The claim that usage at a reasonable 24°C is the cause is not technically valid; the leak is a mechanical failure.

The resulting black mold is a direct consequence of this unresolved water intrusion. In the humid Dubai climate, where AC units run year-round to manage both temperature and humidity, any persistent leak will rapidly lead to mold growth, especially in hidden areas like behind curtains. This poses a potential health risk and can damage building materials.

Your responsibility as a tenant is to report the issue in writing to the landlord or property management company immediately, providing clear evidence (photos/videos) of both the leak source and the mold growth. This formal notification is crucial. If the landlord refuses to address it, you can escalate the matter by filing a complaint with the Dubai Land Department's Rental Dispute Center (RDC).

For a case like this, a professional inspection is mandatory. We need to identify the exact species of mold (e.g., Stachybotrys, Cladosporium) through air and surface sampling and determine the full extent of the infestation, which often spreads behind walls. DIY cleaning is ineffective and can aggravate spore dispersal.
