Who handles black mold cost, tenant or landlord?« Back to Previous Page

My kids have been coughing at night and I just found a patch of black mold behind the wardrobe in our master bedroom in Al Barsha. We’ve been running the AC constantly because of the heat, but it feels more humid than usual inside. Who is responsible for handling this and the cost, me or my landlord?

In the UAE, particularly in Dubai, responsibility for mold remediation is primarily determined by the tenancy contract and the cause of the infestation. Under Dubai's rental laws (Law No. 26 of 2007), the landlord is responsible for maintaining the structural integrity of the property and addressing issues arising from inherent building defects, such as faulty AC systems, leaking pipes in walls, or inadequate waterproofing that leads to condensation and moisture buildup. The tenant is typically responsible for damages or issues resulting from their own negligence, such as failure to operate the AC correctly, not reporting leaks promptly, or poor ventilation leading to excessive humidity.

Given your location in Al Barsha and the constant AC use, the issue is likely exacerbated by our climate. The extreme outdoor humidity, combined with potential issues like an undersized or malfunctioning AC unit (which fails to dehumidify properly), or thermal bridging causing condensation within walls, often creates the perfect environment for mold. The discovery behind the wardrobe suggests a possible hidden condensation point or a slow leak.

For a definitive answer on responsibility and cost, a professional inspection is critical. Our certified mold inspectors at Saniservice can conduct a comprehensive assessment to identify the precise moisture source and extent of contamination. This technical report is essential evidence for determining liability as per your contract and Dubai regulations. For immediate consultation and to schedule an inspection, please call 800-MOLDS (800-66537) or email hello@saniservice.com. Do not attempt to remove significant mold growth yourself, as improper handling can aerosolize spores and exacerbate health issues like the coughing you've observed.
