Who is responsible for mold remediation in a rental?« Back to Previous Page

Our master bedroom closet in our Jumeirah Village Triangle apartment has had this weird damp smell since the humidity started spiking a few weeks ago. I finally pulled out all our winter clothes and found patches of black mold growing on the back wall and on a couple of leather bags. We’ve been in this rental for three years without any issues. Who is responsible for arranging and paying for a proper mold inspection and remediation here, me as the tenant or the landlord?

In the UAE, the responsibility for mold remediation in a rental property is primarily determined by the tenancy contract and the cause of the mold growth. Under Dubai Law No. 26 of 2007 (as amended), the landlord is obligated to provide a habitable property and maintain the structural integrity of the building, including the proper functioning of critical systems like air conditioning. If the mold is a result of a structural defect, such as a hidden water leak from a pipe in the wall, a faulty AC drainage system causing condensation buildup, or inadequate waterproofing, the financial responsibility for inspection and remediation falls on the landlord.
However, as the tenant, you have a responsibility to properly ventilate the premises and use the AC to control the extreme humidity levels prevalent in Dubai. If the mold is deemed to be a result of tenant negligence—such as failing to run the AC, blocking ventilation, or improper storage that traps moisture—you could be held liable for the costs. Given your situation in Jumeirah Village Triangle, the location within a closet and on personal items like leather bags suggests high localized humidity, often exacerbated by air conditioning not effectively reaching enclosed spaces. The first step is a professional inspection to definitively identify the moisture source. This is critical for determining liability. DIY attempts can disturb toxic spores and are not advised. We strongly recommend you contact the landlord immediately, document the issue with photographs, and request a professional assessment. For a definitive diagnosis and remediation plan, our certified team at Saniservice can perform a comprehensive inspection, including moisture mapping and air quality testing, to identify the root cause.
