Who is responsible for AC leak and mold in rental?« Back to Previous Page

The AC in our bedroom in Jumeirah Village Circle has been leaking a little, and now we've got a patch of black mold spreading on the wall behind the wardrobe. My landlord says it's due to us not maintaining the AC, but we get it serviced every year. Who is actually responsible for fixing the mold and the leak in a rental apartment?

Based on UAE rental law, specifically Law No. (26) of 2007 and its amendments, the responsibility for maintenance is clearly defined. Structural issues and the maintenance of fixed installations, such as the internal AC unit and its condensate drain line, are the legal responsibility of the landlord. This is considered a fundamental part of providing a habitable property.

Your annual AC servicing is excellent for the unit's mechanics but typically does not cover the sealed drainage pipes within the walls. A leak from the AC unit, often due to a blocked or cracked drain pipe, leads to persistent moisture. In Dubai's high humidity climate, this creates a perfect environment for mold growth within 24-48 hours. The mold on the wall is a direct symptom of the leak, not the cause.

Therefore, the landlord is obligated to repair the source of the leak (the AC drain line) to prevent further damage. The resulting mold remediation should also be addressed by them, as it is damage caused by their property's faulty fixture. We strongly advise you to formally notify your landlord in writing about the issue, citing the law, and request immediate repairs.

For a definitive assessment, a professional inspection is crucial. We can identify the exact source of the leak, the extent of the mold contamination behind the wardrobe, and provide a detailed report that can be used to formally liaise with your landlord. Mold in this context is a health and safety issue that requires proper remediation, not just superficial cleaning.
