Who is responsible for black mold in a Dubai rental?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold I just found growing along the bottom of the wardrobe in our master bedroom. We’ve lived here for 2 years and just noticed it, but it seems to have spread behind the furniture. The landlord is saying it's from our AC usage and our problem to fix. Who is legally responsible for the mold remediation and repair in a rental here in Dubai?

Based on UAE Civil Code and the Rental Law, the responsibility for mold remediation in a rental property is generally determined by the cause of the moisture. The landlord is legally obligated to provide a habitable property and is responsible for structural issues that cause water intrusion, such as leaks in the roof, external walls, or plumbing within the building fabric. The tenant, however, is responsible for damages resulting from negligence or misuse, such as failing to operate the AC properly to control humidity.
In Dubai's climate, where high humidity and condensation are constant challenges, proper AC usage is critical. If the mold is a direct result of the tenant not using the AC to maintain adequate dehumidification, the responsibility may fall on them. However, mold discovered behind furniture, as you've described, often indicates a more persistent issue, such as a hidden leak or inadequate insulation—which are the landlord's responsibility. Given the health symptoms your children are experiencing, this is a serious matter. We strongly recommend a professional mold inspection to identify the exact moisture source and type of mold. Our certified inspectors use tools like thermal imaging and moisture meters to pinpoint hidden problems and provide a legally defensible report. This evidence is crucial for discussing responsibility with your landlord. Do not attempt to remove significant mold growth yourself, as improper handling can exacerbate spore release and health risks.
