Who is responsible for mold inspection in my Dubai apartment?« Back to Previous Page

We’ve lived in our Jumeirah Village Circle apartment for two years and just noticed a patch of black mold spreading from behind our bedroom wardrobe. The AC unit in that room has been leaking on and off for months, which I’ve reported to the landlord, but they only sent a handyman for a quick fix. Now my allergies are acting up constantly. Who is legally responsible for arranging and paying for a proper mold inspection here, me or the landlord?

Based on UAE Civil Law and the standard rental contract regulations in Dubai (RERA), the landlord is unequivocally responsible for maintaining the property in a habitable condition. This includes addressing the root causes of mold, such as the leaking AC unit you have repeatedly reported. The persistent moisture from the AC leak is a structural and maintenance issue, making the landlord liable for the resultant damage and the required remediation.

Given the visible growth and your allergic reactions, this is a serious health concern that requires immediate professional attention. A proper mold inspection in Dubai's humid climate is critical, as DIY assessments are insufficient. Our certified inspectors use tools like thermal imaging and moisture meters to pinpoint the exact source of the leak and assess the full extent of the contamination, including within walls and behind fixtures, which is common with AC condensation issues.

I strongly advise you to formally notify your landlord in writing, referencing your previous complaints, and insist they commission a professional mold inspection and subsequent remediation. If they are unresponsive, you may escalate the matter to the Rental Dispute Center (RDC). For an immediate, expert assessment to document the issue for your landlord or the RDC, you can contact our team at Saniservice.
