Is black mold cleanup my or my landlord's responsibility?« Back to Previous Page

My kids have been coughing and I suspect it's because of the black mold I just found in the closet of our master bedroom in our rented Jumeirah apartment. We’ve lived here for 2 years and just noticed it growing behind the shoe rack, probably because of the recent humidity. Is it my responsibility to handle the cleanup, or should I be contacting my landlord about this?

In the UAE, landlord-tenant responsibilities for mold remediation are primarily governed by the rental contract and Law No. 26 of 2007, as amended. Typically, the structural integrity and maintenance of the property, including issues arising from inherent building faults like leaking pipes or faulty external waterproofing, are the landlord's legal responsibility. However, the tenant is responsible for maintenance resulting from their own actions or negligence, such as inadequate ventilation leading to condensation.

Given your description, the mold growth behind a shoe rack in a closet is highly suggestive of a localized humidity issue exacerbated by Dubai's intense climate. Year-round AC use creates significant temperature differentials, and when combined with poor air circulation (e.g., from a piece of furniture placed against a wall), it leads to condensation—the primary catalyst for mold. The recent humidity would have accelerated this process.

Your first step is to formally notify your landlord or property management company in writing, with photographs. Do not attempt to clean significant black mold (likely Stachybotrys chartarum) yourself, as improper agitation can aerosolize toxic mycotoxins, potentially worsening your children's respiratory symptoms. The landlord should arrange for a professional inspection to determine the root moisture source. This is critical; simply cleaning the visible growth without addressing the cause will lead to rapid recurrence.

For a definitive assessment and to ensure the remediation is handled safely and effectively, I strongly recommend a certified inspection. Our team at Saniservice can provide a comprehensive moisture mapping and air quality test to identify the exact species and extent of contamination, providing a report you can present to your landlord.
