Is landlord responsible for mold in Dubai apartment?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a big patch of black mold in the corner of our master bedroom closet, behind some storage boxes. It seems to have been growing slowly for a while, and the wall feels damp to the touch. With all the humidity lately, I'm worried it's getting worse. Is my landlord legally responsible for the mold remediation, or is this something I have to handle and pay for myself as the tenant?

In the UAE, a landlord's responsibility for mold remediation is primarily determined by the cause of the moisture. According to Dubai rental law (Law No. 26 of 2007), the landlord is obligated to deliver and maintain the property in a habitable condition. This includes addressing structural or maintenance-related defects, such as leaking pipes, faulty AC drain pans, or water ingress from external cracks in the building envelope, which are common culprits for dampness leading to mold.

However, tenant liability comes into play if the moisture issue is a direct result of occupant behavior. In Dubai's high-humidity climate, inadequate ventilation is a leading cause. If the mold growth is due to a failure to use the AC system properly, obstructing ventilation grilles, or generating excessive indoor humidity without proper exhaust (e.g., from drying clothes indoors), the tenant may be held responsible for the resulting damage and cleanup costs.

Given your description—the mold is behind storage boxes on a damp wall—this strongly suggests a localized humidity trap and possible condensation issue, exacerbated by lack of air circulation. However, a persistent damp feel could also indicate a hidden leak. A professional inspection is critical to definitively identify the source. Our certified inspectors use moisture meters, thermal imaging, and air quality testing to distinguish between condensation and an active leak, which is essential for determining liability.

We strongly advise against DIY removal, especially for a significant patch, as improper handling can aerosolize spores and spread contamination.
