Who is responsible for mold removal, tenant or landlord?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a big patch of black mold behind the wardrobe in the master bedroom. It must have been growing for a while, hidden by the furniture. The dehumidifier runs constantly but the wall feels damp. Who is responsible for the mold removal and fixing the wall, me as the tenant or my landlord?

In the UAE, the responsibility for mold remediation is typically determined by the cause of the moisture, as outlined in standard tenancy contract obligations. The landlord is responsible for maintaining the structural integrity of the property. This includes fixing underlying issues like leaking pipes, faulty AC drainage, or cracks in the building envelope that allow water ingress, which are the most common causes of persistent dampness in Dubai's climate. The subsequent mold removal and wall repair would also fall under their purview.

However, as the tenant, you are responsible for maintaining the property in a clean and habitable condition. If the mold growth is determined to be a direct result of your lifestyle—such as inadequate ventilation, not using extractor fans, or blocking AC vents with furniture—you could be held liable for the cleanup costs.

Given that your dehumidifier is running constantly and the wall itself feels damp, this strongly suggests an underlying structural or mechanical moisture issue rather than simple condensation from daily living. The hidden location behind the wardrobe further indicates it was not caused by a lack of cleaning.

We strongly advise you to contact your landlord immediately and recommend a professional mold inspection. A certified inspector can identify the precise moisture source and determine the root cause, which will definitively assign responsibility. Do not attempt to remove significant mold growth yourself, as improper handling can aerosolize spores and exacerbate the problem.
