Who is responsible for black mold, tenant or landlord?« Back to Previous Page

We’ve lived in our Jumeirah Village Circle apartment for two years and just noticed what looks like a large patch of black mold behind our wardrobe. It's on the wall facing the outside, and it's gotten worse since the humidity spiked a couple of weeks ago. Who is responsible for getting this inspected and fixed, me or the landlord?

In the UAE, particularly in humid climates like Dubai, the responsibility for black mold remediation is often determined by the cause of the moisture, as outlined in Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai (as amended).
If the mold growth on your external wall in Jumeirah Village Circle is a result of a structural defect, such as a leaking pipe within the wall, a crack in the building envelope, or faulty external waterproofing that allows moisture ingress, then the responsibility for inspection and remediation falls squarely on the landlord. They are obligated to maintain the property's structure and ensure it is habitable. However, responsibility may shift to you, the tenant, if the cause is determined to be internal and preventable. In Dubai's climate, this primarily involves condensation due to improper ventilation. Placing large furniture like wardrobes directly against an external wall can create a cold spot where moisture from the air condenses, especially with year-round AC use creating a significant temperature differential. A lack of adequate airflow in that area provides the perfect environment for mold. Given that the patch is large and on an external wall, a structural issue is a strong possibility. We strongly recommend a professional inspection to definitively identify the moisture source. Our certified inspectors use tools like thermal imaging cameras and moisture meters to differentiate between condensation and intrusion. This objective report is crucial for determining liability under Dubai law. For an accurate assessment and to resolve this issue correctly, please contact our specialists at Saniservice.
