Is fixing AC leak and mold my landlord's responsibility?« Back to Previous Page

The AC unit in our master bedroom in Jumeirah Village Circle has been leaking a bit, and now we've got a big patch of black mold spreading on the wall behind the wardrobe. It's been getting worse over the last couple of weeks since the last sandstorm. Is fixing this and cleaning the mold the responsibility of my landlord, or is this on me to handle?

Based on UAE tenancy law, specifically Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai, the responsibility for structural repairs and maintenance of essential services like the air conditioning system falls upon the landlord. An AC unit leak is a maintenance issue stemming from the fixture itself, making it the landlord's obligation to rectify.

The resulting mold growth is a direct consequence of that unrepaired leak. The unique climate in Dubai, with its high humidity and the necessity for year-round AC operation, creates a perfect environment for mold proliferation, especially after events like sandstorms which can clog drain lines and introduce spores. The black mold you describe behind the wardrobe is a serious concern that requires immediate attention.

However, you must formally notify your landlord or property management company in writing about the issue to activate their responsibility. Delaying this notification could potentially lead to you being held liable for further damage.

For a situation of this magnitude, a professional inspection is non-negotiable. The mold is hidden behind furniture, indicating a significant colony, and black discoloration can often point to Stachybotrys chartarum, a toxigenic species. DIY cleaning is insufficient and hazardous, as it can aerosolize spores throughout your home.

We strongly recommend you contact a certified mold remediation specialist like Saniservice. Our experts can conduct a comprehensive assessment, including moisture mapping and air quality testing, to determine the full extent of the contamination and provide a protocol for safe, effective remediation that we can present to your landlord.
