Is black mold removal my landlord's responsibility?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a large patch of black mold in the corner of our master bedroom closet, behind some storage boxes. It must have been growing slowly for a while, but I only found it when I was doing a deep clean. The dehumidifier in the hallway has been acting up for a month, so I think the humidity caused it. Is getting this professionally removed my landlord's responsibility or do I have to pay for it myself?

Based on UAE rental law, specifically Law No. (26) of 2007, the landlord is typically responsible for maintaining the structural integrity of the property and addressing issues arising from inherent building defects, such as persistent dampness or faulty air conditioning systems. Since you've identified a malfunctioning dehumidifier as the likely cause, this points to a failure in the property's climate control system, which is a landlord-provided amenity. The resulting black mold (likely Stachybotrys chartarum or Aspergillus niger) is a direct consequence of this unresolved humidity issue.

However, the immediate course of action is critical. You must formally notify your landlord or property management company in writing about the issue, including photographic evidence. This officially documents the problem and starts the legal clock for them to respond and rectify the situation. Do not attempt to remove it yourself, as improper remediation can aerosolize toxic mycotoxins, spreading the contamination throughout your apartment and posing a significant health risk.

Given Dubai's high ambient humidity and year-round reliance on AC, moisture problems must be handled by professionals. We strongly recommend a certified mold inspection to determine the exact species and the full extent of the contamination, which is often not visible to the naked eye.
