Who is responsible for mold in a Dubai rental?« Back to Previous Page

We've lived here for 2 years and just noticed a large patch of black mold spreading on the wall behind our wardrobe in the bedroom. It must have been there a while, hidden by the furniture, and the humidity these past few weeks has probably made it worse. Our landlord is saying it's our fault for not ventilating properly, but the AC is always on. Who is legally responsible for the mold remediation and any repairs in a rental here in Dubai, the tenant or the landlord?

In the UAE, the responsibility for mold remediation in a rental property is primarily dictated by the cause of the moisture intrusion, as outlined in the Dubai Rental Law. The landlord is legally obligated to provide a habitable property and is responsible for addressing issues related to structural defects, faulty construction, or inherent building problems, such as leaking pipes, cracks in the external walls, or defective air conditioning systems that cause condensation. Conversely, the tenant is responsible for damages resulting from negligence, such as a failure to adequately ventilate the property or report a pre-existing issue in a timely manner.

Given Dubai's high humidity levels and the constant use of AC, which can lead to significant condensation if not properly maintained, the cause is often complex. A wardrobe placed against an external wall is a classic scenario for hidden mold growth due to restricted airflow and potential thermal bridging. The landlord's assertion that it's due to improper ventilation may be an attempt to shift liability.

For a definitive determination of liability and a comprehensive remediation plan, a professional inspection is essential. Our certified inspectors at Saniservice conduct a thorough assessment to identify the precise moisture source and extent of contamination, providing a detailed report that can be used to establish legal responsibility with the landlord. We strongly recommend you schedule an inspection to protect your health and your rights. For immediate assistance, please call us at 800-MOLDS (800-66537) or email hello@saniservice.com.
