Who is responsible for black mold in a rental apartment?« Back to Previous Page

We’ve lived in our Marina apartment for 2 years and just noticed a large patch of black mold behind the wardrobe in our master bedroom. It must have been there a while, hidden by the furniture, and the humidity has been brutal lately. Who is responsible for dealing with this and the cost of remediation—us as tenants or our landlord?

In the UAE, the responsibility for mold remediation in a rental property is typically governed by the lease agreement and the Dubai Rental Law. Generally, the structural integrity and maintenance of the property, including issues arising from inherent building faults like leaking pipes or faulty AC drainage systems that lead to condensation, are the landlord's financial responsibility. This is because they are obligated to provide a habitable dwelling.

However, tenant responsibilities include maintaining proper ventilation to mitigate the extreme humidity common in Dubai, especially in coastal areas like Marina. If the mold growth is a direct result of tenant negligence—such as failing to use the AC consistently to control humidity, not reporting a water leak promptly, or obstructing ventilation with furniture (like the wardrobe in your case)—the cost of remediation may fall to you. The hidden nature of this mold suggests it may be due to a persistent environmental condition rather than a recent, acute spill.

Given the extent you've described, a professional inspection is critical. Our certified inspectors at Saniservice can conduct a comprehensive assessment to determine the moisture source, identify the mold species (to assess potential health risks), and provide a definitive report on the cause. This evidence is essential for determining liability between tenant and landlord.
