Who is responsible for mold from a leaking AC?« Back to Previous Page

My kids have been coughing for the past few weeks and I've just found a patch of black mold behind the wardrobe in our master bedroom. We’re in an older building in Bur Dubai and the AC unit in that room seems to constantly drip and make the wall damp. I’ve told my landlord but he says it's our responsibility to clean it. Who is legally responsible for fixing the leak and the mold remediation, the tenant or the landlord?

In the UAE, specifically Dubai, the responsibility for mold resulting from a leaking AC unit is a matter defined by tenancy law. The general principle under Law No. (26) of 2007, amended by Law No. (33) of 2008, places the responsibility for major maintenance and structural repairs on the landlord. This includes the building's central AC system, chiller lines, and the structural integrity of the property that prevents water ingress.

A leaking AC unit that causes dampness and subsequent mold growth falls under this category. The landlord is legally obligated to repair the source of the leak—whether it's a faulty condensate drain line, a blocked drain pan, or issues with the chiller supply. The constant moisture from the drip, combined with our high humidity and year-round AC use, creates a perfect environment for toxic black mold (like Stachybotrys chartarum) to proliferate, which is a serious health hazard, particularly for children exhibiting respiratory symptoms like persistent coughing.

However, the tenant is typically responsible for routine cleaning and minor maintenance. While your landlord is correct that superficial cleaning might be your duty, the remediation of mold caused by their unresolved structural issue is not.

Given the health implications for your family and the legal technicalities, I strongly recommend a professional inspection. Our certified team at Saniservice can conduct a thorough assessment to identify the exact species of mold and the precise cause of the moisture. This detailed report is crucial evidence for formally requesting your landlord to fulfill their obligation and execute proper repairs and remediation. Do not attempt to remove significant black mold yourself, as improper handling can aerosolize toxins and exacerbate the problem.
