Who is responsible for bathroom mold remediation, tenant or landlord?« Back to Previous Page

We've been in our Discovery Gardens apartment for about a year, and this persistent black mold keeps coming back in the grout between the bathroom tiles, no matter how much I scrub it. The bathroom doesn't have a window and the exhaust fan is really weak, so it never fully dries out after my morning shower. Who is responsible for dealing with this - am I supposed to fix the ventilation and cleaning myself, or should my landlord handle the mold remediation?

In the UAE, the responsibility for mold remediation in a rental property is typically determined by the cause of the moisture. Under Dubai's rental law (Law No. 26 of 2007), the landlord is responsible for maintaining the structural integrity of the property, which includes major building systems like ventilation. If the persistent mold growth is a direct result of inadequate ventilation, such as a malfunctioning or underpowered exhaust fan, the onus is on the landlord to rectify this issue. The chronic high humidity and condensation from showers, exacerbated by our climate's year-round AC use, creates a perfect environment for mold if not properly exhausted.
However, as the tenant, you are responsible for daily maintenance and ensuring the property is kept in a clean and hygienic condition. This includes regular cleaning to prevent surface mold from soap scum and organic matter. Given your description, the core issue is a systemic ventilation failure. You should formally notify your landlord in writing of the defective exhaust fan and the recurring mold, requesting they install a higher-capacity unit suitable for a windowless bathroom. For a definitive assessment of the mold's extent and to document the cause for your landlord, a professional inspection is highly recommended. Our certified technicians at Saniservice can conduct a thorough assessment, including moisture mapping and air quality testing, to provide an official report. For serious, persistent cases like this, professional remediation is often necessary to resolve it permanently. Call 800-MOLDS (800-66537) or email hello@saniservice.com for a consultation. |
