Is black mold removal my or landlord's responsibility?« Back to Previous Page

We've lived here for 2 years and just noticed a huge patch of black mold behind the wardrobe in our master bedroom in JLT. It must have been growing for ages, and with the humidity lately, it's gotten way worse. We're worried about our health and the damage. Is it my responsibility as a tenant to pay for the removal, or should my landlord handle this?

In the UAE, the responsibility for mold remediation is primarily determined by the cause of the growth. According to standard tenancy contract interpretations and Dubai rental law (Law No. 26 of 2007), the landlord is responsible for maintaining the structural integrity of the property. This includes addressing issues arising from inherent building defects, such as leaking pipes within the walls, faulty external waterproofing, or inadequate insulation leading to condensation.
However, tenant responsibilities typically cover mold resulting from occupant behavior. This includes failure to adequately ventilate the property, not using exhaust fans in bathrooms, or intentionally damaging the property. Given that the mold in your JLT apartment is behind a wardrobe—a classic spot for condensation due to restricted air circulation against a cold external wall—the cause is likely a building-related thermal bridge, exacerbated by our high humidity and year-round AC use. For a case you describe as "huge," a professional inspection is absolutely critical. A certified mold assessor can identify the precise moisture source through thermal imaging and moisture meters, which is essential for determining liability. Attempting removal without fixing the root cause will lead to rapid regrowth. We strongly recommend you contact your landlord immediately and request a professional assessment. For expert inspection and definitive remediation that addresses the source, not just the visible growth, you can call Saniservice at 800-MOLDS (800-66537) or email hello@saniservice.com. They can provide a detailed report that will be crucial for discussions with your landlord regarding responsibility and the required rectification work. |
