Who pays for mold removal: tenant or landlord?« Back to Previous Page

My kids have been coughing and I suspect it's the black mold that's been spreading along the ceiling in our master bedroom closet. It started as a small patch after the heavy rains in January, but now it's grown a lot. I've been wiping it with vinegar, but it just comes back worse. Am I responsible for paying for a professional mold removal service, or is this something my landlord in JLT has to handle?

In the UAE, the responsibility for mold remediation is typically governed by the rental contract and Law No. 26 of 2007, known as the Dubai Rental Law. The general principle is that the landlord is responsible for the structural integrity and maintenance of the property's major systems. This includes issues stemming from inherent building defects, such as leaking central AC ducts, faulty plumbing within the walls, or inadequate waterproofing that led to water ingress after the heavy rains you mentioned. If the mold growth in your JLT closet is a direct result of such a structural or maintenance issue, the financial responsibility for professional remediation falls on the landlord.

However, the tenant is responsible for damages caused by their own negligence or misuse. This includes mold resulting from a failure to use the AC adequately to control humidity, blocking ventilation grilles, or not reporting a minor leak in a timely manner, allowing it to develop into a major problem. Your attempt to clean it with vinegar is a common mistake; vinegar only removes surface discoloration on non-porous materials but does not address the hyphal roots penetrating the ceiling board or the underlying moisture source, hence its rapid return.

Given the symptoms your children are exhibiting and the recurrent nature of the growth, a professional inspection is absolutely critical. Our certified inspectors at Saniservice can conduct a comprehensive assessment to identify the exact species of mold (e.g., Stachybotrys chartarum, or common Aspergillus) and, most importantly, use moisture meters and thermal imaging to pinpoint the precise moisture source. This evidence-based report is essential for determining liability between you and your landlord.

Do not delay, as this is a health and safety issue. For immediate advice and to schedule a definitive inspection, please call our experts at 800-MOLDS (800-66537) or email hello@saniservice.com. We will provide the documentation needed to resolve the liability question with your landlord and execute a complete, permanent remediation.
