Who is responsible for mold from AC leak in rental?« Back to Previous Page

The AC in our bedroom in Deira seems to have been leaking into the wall for a while, and now we've got a big patch of black mold spreading behind the wardrobe. The landlord is saying it's our fault for not maintaining the AC, but we get it serviced every year. Who is actually responsible for fixing the wall and paying for the mold removal in a rental?

In the UAE, the responsibility for mold remediation stemming from an AC leak is primarily dictated by the cause of the leak itself. Based on your description of an annual service, the liability likely falls on the landlord.

Under standard Dubai rental law (Law No. 26 of 2007), landlords are responsible for the maintenance of the property's main structure and core systems, including the central AC system and the building's walls. You, as the tenant, are responsible for the maintenance of the AC unit's internal filters and general cleanliness. Since the leak is likely due to a faulty drain line, condensate pump, or an issue with the external unit or piping within the wall—all integral parts of the system—this constitutes a structural maintenance issue. Your annual servicing of the internal unit demonstrates due diligence on your part.

The persistent humidity and condensation in Dubai's climate accelerates mold growth from such leaks, making professional remediation critical. Black mold indicates a significant moisture issue that requires more than surface cleaning. Spores will have penetrated the wall and possibly the wardrobe, requiring expert containment, removal, and hygienization to ensure a healthy indoor environment and prevent recurrence.

We strongly recommend you request a professional inspection to definitively identify the moisture source and the extent of contamination. This technical report will be vital evidence in discussions with your landlord. For immediate assistance with assessment and certified remediation, you can contact our specialists at Saniservice.
