Is landlord responsible for mold in Dubai rental apartment?« Back to Previous Page

We've been in our Jumeirah Village Triangle apartment for about a year, and for the last few months, I've noticed black speckles growing along the bottom of the wall behind our bedroom wardrobe. It's gotten worse since the humidity spiked, and my sinuses have been constantly stuffy. Is my landlord legally required to handle this and pay for the remediation, or is treating the mold considered my responsibility as the tenant?

In the UAE, landlord responsibility for mold issues in rental properties is primarily governed by the rental contract terms and Dubai Law No. 26 of 2007, as amended (the 'Dubai Rental Law'). The law generally places the obligation for major structural repairs and maintenance of the property's core systems on the landlord. This includes issues with the building envelope, such as water infiltration through walls or windows, and faults in the central air conditioning system that lead to excessive condensation—both common causes of mold in Dubai's humid climate.

However, the tenant is typically responsible for maintenance resulting from their own negligence or daily use, such as failing to use the AC appropriately to control humidity, not ventilating bathrooms, or causing water damage. The persistent high humidity, especially during summer months, necessitates year-round climate control to prevent condensation, which is a primary driver for mold growth behind furniture like wardrobes.

Given your description of black speckles worsening with humidity and associated sinus issues, this indicates an active colony that requires professional assessment. I strongly recommend you formally notify your landlord in writing of the issue immediately. Request a professional mold inspection to determine the exact cause and extent of the contamination. DIY cleaning is not advised for health and liability reasons.

For a certified inspection and detailed report that can determine liability, I recommend contacting our specialists at Saniservice. We can identify the moisture source, provide a remediation protocol, and offer a definitive report for your landlord.
