Who is responsible for mold inspection in a UAE rental?« Back to Previous Page

My kids have been coughing at night and I’ve just discovered what looks like black mold along the bottom edge of the wall behind our wardrobe in the master bedroom. This is in our rental apartment in Jumeirah Village Circle, and we’ve been here for about a year. I’ve read that humidity can cause it, but I’m not sure if this is something I need to handle myself or if I should contact my landlord. Who is legally responsible for arranging and paying for a professional mold inspection here in the UAE?

In the UAE, the responsibility for mold inspection and remediation in a rental property is typically defined by the tenancy contract and the Civil Code. The landlord is generally responsible for maintaining the structural integrity of the property and ensuring it is habitable. Since mold is often a symptom of a persistent underlying issue—such as a hidden water leak from plumbing, a faulty AC drainage system, or poor building envelope integrity—the financial and logistical responsibility for a professional inspection usually falls on the property owner.

The humid climate in Dubai, particularly in coastal areas like Jumeirah Village Circle, creates a high risk for condensation and mold growth, especially if the AC is not running consistently to manage humidity levels. The presence of black mold and associated health symptoms, like your children's nighttime coughing, elevates this to a serious habitability issue. You should formally notify your landlord or property management company in writing immediately. Include clear photographs of the mold and a description of the health symptoms. This documents the issue and starts the legal clock for their response.

We strongly advise against handling suspected toxic black mold yourself, as improper disturbance can aerosolize spores and exacerbate health risks. A professional inspection is critical to identify the exact species and, more importantly, the root moisture source. The inspection will include moisture mapping, thermal imaging, and air quality testing to provide a legally defensible report for the landlord.
