Is landlord responsible for bathroom mold form weak fan??« Back to Previous Page

We've lived in our Marina apartment for two years and just noticed black spots growing along the grout in the shower. It's been way more humid than usual the last few weeks and the exhaust fan seems weak. Is the landlord responsible for fixing the fan and the mold remediation, or is cleaning this up my job as the tenant?

In the UAE, specifically Dubai, the responsibility for mold remediation and repairing ventilation issues like a weak exhaust fan is typically governed by the rental contract and Law No. 26 of 2007, known as the Dubai Rental Law. Generally, the landlord is responsible for maintaining the structural integrity of the property and its core systems, which includes fixed mechanical ventilation like bathroom exhaust fans. If the fan's weakness is a pre-existing condition or a failure of the installed system, it is the landlord's obligation to repair or replace it.

The resulting mold growth, however, often becomes a point of contention. While the landlord must provide a habitable property, tenants are responsible for maintaining daily cleanliness and ensuring adequate ventilation is used. Your description of the recent high humidity—a common challenge in Dubai's climate, especially during summer months and in coastal areas like Marina where condensation is frequent—paired with a known weak fan strongly suggests the root cause is a maintenance issue. You should notify your landlord in writing immediately about the faulty fan and the emerging mold. Request that they address both the source of the moisture (the fan repair) and the resulting contamination.

For a definitive assessment of liability and the scope of remediation, a professional mold inspection is crucial. Our certified inspectors at Saniservice can perform precise air and surface sampling to identify the mold species and concentration, and provide a detailed report that can be used to formally establish responsibility with your landlord. Attempting to clean significant mold growth without addressing the underlying moisture issue will lead to rapid recurrence.
