Is landlord responsible for mold inspection cost?« Back to Previous Page

My kids have been coughing a lot and I suspect it's from the black mold I just found behind our wardrobe in the master bedroom. We've lived in this Marina apartment for two years, but this only appeared after the humidity really spiked last month. Is getting a professional mold inspection the landlord's responsibility to pay for, or is that on me as the tenant?

In the UAE, and specifically Dubai, the responsibility for mold inspection and remediation is typically determined by the tenancy contract and the cause of the mold growth. Under Dubai Law No. 26 of 2007 (Amended by Law No. 33 of 2008), the landlord is legally obligated to provide a habitable property and maintain the structural integrity of the building. This includes addressing issues arising from inherent building defects, such as leaking pipes, faulty waterproofing, or inadequate external sealing that allows moisture ingress.

However, the high humidity and constant air conditioning use common in Dubai create a unique environment where tenant behavior can also be a contributing factor. If the mold is a direct result of the tenant's actions—such as failing to use the AC to control humidity, blocking ventilation grilles, or creating excessive moisture without proper exhaust—the responsibility for remediation may fall to the tenant.

Given your description, the sudden appearance after a humidity spike points strongly to an environmental cause. The presence of black mold (Stachybotrys chartarum) and associated health symptoms like coughing in children elevates this to a serious health and safety issue that requires immediate professional assessment. A DIY inspection is insufficient as it will not identify the moisture source or the full extent of contamination.

I strongly recommend you formally notify your landlord in writing of the issue and request a professional mold inspection. Given the potential health risks, they are often compelled to act.
