Landlord or tenant responsible for black mold in Dubai apartment?« Back to Previous Page

We've lived in our Jumeirah Village Circle apartment for 2 years and just noticed a patch of black mold in the corner of our main bedroom closet, behind some storage boxes. It seems to have spread from the wall, and the room has felt damp lately despite the AC running. Who is responsible for dealing with this and the cost of remediation—is it me as the tenant, or is the landlord required to fix it?

Based on Dubai's rental laws, specifically Law No. 26 of 2007 and its amendments, the responsibility for structural repairs and issues related to the core integrity of the property falls on the landlord. This includes problems arising from inherent building defects, such as faulty waterproofing, leaking central AC condensation lines within the walls, or structural cracks allowing moisture ingress. The black mold you've discovered behind storage in a closet corner is a strong indicator of a persistent dampness issue, likely stemming from a hidden leak or condensation problem, which is the landlord's responsibility to investigate and rectify.

As the tenant, your responsibility is limited to maintaining the property in a clean condition and reporting any such issues promptly. However, the cost of professional mold remediation itself can be a point of contention. The landlord is responsible for fixing the source of the moisture. If the mold growth is a direct result of that structural failure, they should also cover the cost of the resultant remediation. If the mold is deemed to be due to tenant negligence (e.g., lack of ventilation, blocking AC vents, or failing to report a leak immediately), you could be held liable.

Given the climate in Dubai, with high humidity and year-round AC use leading to significant condensation risks, this is a serious matter. We strongly recommend a professional inspection to identify the exact moisture source and assess the extent of the mold growth, which is often more widespread than what is visible. This certified report will be crucial evidence in discussions with your landlord regarding responsibility.
