Who is responsible for black mold near AC vent?« Back to Previous Page

The AC in our bedroom has been making this weird damp smell for a couple of months, and I just pulled back the corner of the carpet near the vent and found a bunch of black mold. We're in an older building in Jumeirah and our lease is up for renewal soon. Who is responsible for fixing this and the cleanup, us or the landlord?

This is a common and serious issue we encounter in Dubai, particularly in older buildings in coastal areas like Jumeirah. The combination of high ambient humidity and year-round AC use creates a perfect environment for condensation and subsequent mold growth within AC systems and on surrounding cold surfaces.

Regarding responsibility, the answer is typically defined by the tenancy contract and UAE Civil Code provisions. Generally, structural issues and the maintenance of major building systems, including central AC units and the ductwork, fall under the landlord's responsibility. The black mold growth at the vent suggests a problem with the AC unit itself—likely a blocked condensate drain line causing overflow, insufficient insulation on cold air ducts, or a leak in the ductwork. This is a failure of the property's fixture, making the landlord responsible for the remediation and repair.

However, tenant responsibilities include reporting issues in a timely manner and maintaining general cleanliness to not exacerbate moisture problems. Since you've just discovered it, report it to your landlord or property management company immediately in writing, with photographs. Do not attempt to clean it yourself, as disturbing extensive mold growth can aerosolize spores and contaminate your entire living space.

Given the potential health risks and the need to correctly identify the moisture source, a professional inspection is critical. We use thermal imaging and borescopes to inspect inside wall cavities and ductwork to find the exact point of failure. This evidence is crucial for determining the full scope of work and for your landlord to understand the severity.
