Who pays for bedroom mold fix in Jumeirah Village Circle?« Back to Previous Page

We've lived in our apartment in Jumeirah Village Circle for two years and just noticed a patch of black mold spreading from the corner of our bedroom ceiling. It started getting worse after the heavy humidity last month, but we can't tell if it's from an internal leak or just condensation. Who is responsible for getting this fixed and paying for it, us or the landlord?

This is an excellent and very common question for Dubai residents, particularly in high-humidity areas like Jumeirah Village Circle. The responsibility for mold remediation is not always clear-cut and depends entirely on the root cause of the moisture.

Under the Dubai Rental Law (Law No. 26 of 2007), the landlord is responsible for maintaining the structural integrity of the property. This includes fixing leaks from external walls, roofs, or internal plumbing within the building's infrastructure that cause issues like mold. If the black patch on your ceiling is due to a leak from an adjacent apartment, a faulty AC condensation line in the duct, or water seepage from the building envelope, the financial responsibility for both the leak repair and the subsequent mold remediation falls squarely on the landlord.

However, tenant responsibilities are outlined in the tenancy contract and typically require you to maintain the property in a way that prevents damage. The extreme humidity and year-round AC use in Dubai create a significant risk of condensation, especially if the AC is not run consistently or is set at a high temperature while you are away. If the mold is determined to be solely due to condensation from inadequate ventilation or failure to use the AC properly to control humidity, the cost of remediation could be deemed the tenant's responsibility.

Given that you cannot determine the cause, a professional inspection is absolutely critical. We would need to conduct a moisture mapping assessment and possibly thermal imaging to identify the source—be it a hidden leak or condensation. This technical report is essential evidence for discussing responsibility with your landlord or building management.
