Is landlord responsible for black mold inspection?« Back to Previous Page

We've been in our Discovery Gardens apartment for about a year, and this past month, a big patch of black mold has started growing on the wall behind our wardrobe, which is on an exterior wall. My allergies have been terrible ever since it appeared. I’m not sure if this is a pre-existing issue with the building or something we’ve caused. Is the landlord responsible for arranging and paying for a professional mold inspection, or is that on us as tenants?

Under Dubai Law No. 26 of 2007 (Amended by Law No. 33 of 2008), the landlord is generally responsible for maintaining the structural integrity of the property. A mold patch on an exterior wall in Discovery Gardens strongly suggests an underlying moisture issue from a potential leak or seepage, which falls under structural maintenance. You should formally notify your landlord in writing about the issue, as they are typically obligated to address the root cause.
Your worsening allergies indicate a significant indoor air quality concern that requires professional diagnosis. In Dubai's humid climate, where AC systems run year-round, condensation and hidden leaks are common culprits. A proper inspection by a specialist with a microbiology lab can identify the mold species and its moisture source, which is critical for effective remediation. This report will also provide the evidence needed to clarify responsibility. While the landlord handles the structural fix, the cost of a proactive inspection to confirm your health concerns may initially fall to you. However, this diagnostic step is often essential to compel landlord action. Document everything with photos and keep records of all communication. If the landlord is unresponsive, you can escalate the matter to the Rental Dispute Center (RDC) in Dubai, presenting the inspection report as evidence. |
