Who is responsible for closet mold and damaged items?« Back to Previous Page

Our master bedroom closet on the outer wall has started getting these black speckles, and I just pulled out my winter jackets to find a few of them completely ruined. We’ve been in this Deira apartment for about a year, and it’s gotten worse since the humidity spiked a couple of weeks ago. Who is responsible for fixing this and the cost of my damaged belongings – me or my landlord?

Responsibility typically falls on the landlord for structural issues causing the mold and on the tenant for damage to personal belongings.

The black speckles are a classic sign of condensation-related mold, extremely common in Deira due to high humidity and continuous AC use creating temperature differentials on outer walls. The landlord is generally responsible for investigating and rectifying the source of the moisture intrusion if it's a building envelope issue, such as a leaking pipe in the wall or faulty external waterproofing. Under typical Dubai rental contracts, maintaining the structure of the apartment is the landlord's obligation.

However, you are likely responsible for the cost of your damaged jackets, as tenants are expected to manage their belongings and interior humidity levels. For a claim to succeed, you would need to prove the landlord was negligent in addressing a known, reported structural defect.

Your first step is to formally notify your landlord or property management company in writing, with photos, and request a professional inspection to identify the moisture source. Do not attempt to clean it yourself, as improper methods can spread spores. A proper assessment from a company with a microbiology lab can pinpoint the exact cause—whether it's condensation or a leak—which determines liability. In the meantime, improve air circulation in the closet and consider using a dehumidifier to prevent further spread.
