Who is responsible for mold removal in UAE rental?« Back to Previous Page

My bedroom closet in my Jumeirah Village apartment has had this musty smell for weeks, and I just pulled back the clothes to find a huge patch of black mold spreading on the back wall. I think it might be from a hidden AC leak. We’ve been in this rental for about a year and the landlord is saying it’s our fault for not ventilating properly, but we run the AC constantly. Who is legally responsible for the mold removal and repair costs here in the UAE, the tenant or the landlord?

Mold responsibility in UAE rentals depends on the source of the moisture, as outlined in Law No. 26 of 2007. If the mold is caused by a structural issue like a leaking AC pipe inside the wall, a roof leak, or faulty plumbing, the landlord is legally responsible for the repairs and subsequent mold remediation. If the issue is due to tenant behavior, such as failing to use the AC properly leading to condensation, not reporting a leak, or poor ventilation, the tenant may be liable.

Given Dubai's high humidity and year-round AC reliance, condensation behind furniture like a closet against an external wall is common. However, a "hidden AC leak" strongly suggests a maintenance issue with the building's system, which typically falls to the property owner. Ventilation alone rarely causes significant mold growth without an underlying moisture source.

Your first step is to formally notify your landlord in writing about the issue and request an immediate professional inspection to identify the exact moisture source. Do not attempt removal yourself, as improper handling can spread spores. A certified inspector can determine the cause and provide a report, which is crucial evidence. If the landlord refuses to act, you can escalate the matter to the Rental Dispute Center (RDC) in Dubai. For extensive growth, a professional remediation company with a microbiology lab can safely remove the mold and provide documentation that the underlying cause has been resolved.
