Is landlord responsible for bathroom mold causing child's cough?« Back to Previous Page

My kids have been coughing and I suspect it's from the black mold that's been spreading in the corners of our master bathroom. We've lived in this Jumeirah Village Triangle apartment for almost two years, and it's gotten way worse since the humidity kicked in a couple of months ago. The grout in the shower is almost completely black now and the paint on the ceiling is starting to bubble. As a tenant, am I responsible for the cost of cleaning this, or is the landlord required to handle a mold remediation issue like this?

Landlords in Dubai are typically responsible for resolving structural issues that cause mold, like leaking pipes, faulty waterproofing, or inadequate ventilation. Tenants are usually responsible for mold caused by their own actions, like failing to use the bathroom extractor fan. However, the persistent humidity here in Dubai often accelerates pre-existing issues, blurring the lines of responsibility.

The bubbling paint and widespread grout discoloration suggest a deeper moisture problem, likely beyond surface condensation. Given your child's cough, professional assessment is strongly advised to identify the mold species and moisture source. A certified inspection with lab testing can provide a definitive report on the root cause, which is the key document for determining liability.

Start by formally notifying your landlord or building management in writing, with photos. They are generally obligated to address health hazards that make the property uninhabitable. For a clear case of structural failure, they should cover remediation. If they refuse, Dubai's Rental Dispute Center (RDC) can mediate based on the evidence.

In the interim, improve ventilation by running the exhaust fan during and for 30 minutes after showers and keeping the bathroom door open. Wipe down wet surfaces to reduce immediate moisture. For health concerns, a HEPA air purifier in adjacent rooms can help reduce airborne spores until the issue is resolved.
