Is landlord responsible for mold removal cost?« Back to Previous Page

My kids have been coughing for a couple of weeks and I finally pulled their wardrobe away from the wall in our Sharjah apartment, only to find a huge patch of black mold spreading from the corner. The humidity has been terrible lately and I think it's been growing there for months. As a tenant, am I responsible for the cost of cleaning and repainting, or is this something the landlord has to fix because it's a structural dampness issue?

Tenancy law in the UAE generally places the responsibility for structural maintenance on the landlord, while tenants are responsible for upkeep. The black mold you've discovered, likely caused by penetrating damp from the building envelope or a leak, is typically considered a structural issue. This is especially true in Sharjah's climate, where high humidity and condensation from constant AC use can exacerbate pre-existing moisture problems in walls.

You should formally notify your landlord or property management company in writing, with photos, and request immediate remediation. For a case this severe, a professional inspection is critical to identify the moisture source—whether it's a leaking pipe, cracked wall, or insufficient waterproofing. A proper assessment, often involving moisture meters and thermal imaging, provides the evidence needed to establish liability.

While the landlord is usually responsible for fixing the cause (the leak) and the resultant damage (mold removal, wall repairs), the tenant may be responsible for repainting if the tenancy contract specifies that. However, if the mold growth is due to tenant behavior (e.g., blocking ventilation, not using AC), the cost could shift. Given the health symptoms, do not attempt to clean this yourself; improper removal can aerosolize spores and worsen the problem. A certified remediation company can safely remove the mold and provide a clearance test to confirm the air quality is safe, which protects your family and clarifies the issue for the landlord.
