Who is responsible for mold from a leaky AC?« Back to Previous Page

The AC in my apartment seems to be leaking condensation into the wall behind it in our master bedroom. We’ve lived here for 2 years and just noticed a big patch of black mold spreading from the unit down the wallpaper. My landlord says it's a maintenance issue for the building, but the building management says it's the landlord's responsibility to fix. Who is legally responsible for fixing the mold and the leaky AC unit in a rental here?

The responsibility typically falls on the landlord to repair the AC unit and remediate the resulting mold, as it's considered a maintenance issue affecting the habitability of the property. Your tenancy contract is the primary reference; it often stipulates that the landlord is responsible for the maintenance of major appliances like AC units and the building's structure.

In Dubai's humid climate, a leaky AC is a critical issue. The constant condensation, if not properly drained, provides a continuous moisture source that mold requires to thrive. The black patch spreading on your wallpaper is a clear sign of an active, persistent leak that needs immediate attention to prevent further structural damage and potential health concerns.

First, formally notify your landlord in writing (email is best) with clear photos, reiterating that the leaky AC is causing property damage. If they remain unresponsive, you can escalate the matter by filing a complaint with the Rental Dispute Center (RDC) in Dubai. The building management is likely correct that fixing the internal unit and the damage to your apartment's walls is the landlord's responsibility, though they may be responsible for the central chiller or external condensate lines.

Given the visible spread, a professional inspection is strongly advised to assess the full extent of the mold growth within the wall cavity. Proper remediation involves fixing the leak at its source, addressing any saturated building materials, and professionally cleaning the affected areas to prevent recurrence. Simply wiping the visible mold is insufficient.
