Is landlord responsible for mold in Dubai villa closet?« Back to Previous Page

Our family villa in Jumeirah has had a persistent damp smell in the master bedroom closet for the past couple of months, and I just pulled out a stack of winter clothes to find several items covered in black spots. We run the AC constantly, but the closet is on an outside wall. Is my landlord legally required to handle the remediation and replace our damaged belongings, or is this considered our fault for not ventilating properly?

The landlord's responsibility depends on whether the mold is due to a structural defect or tenant lifestyle. In Dubai's climate, the root cause is often a combination of both.

If the mold is a result of a building issue like a hidden leak in the outside wall, faulty insulation causing condensation, or a compromised vapor barrier, the landlord is typically responsible for the remediation and repairs. The persistent damp smell you describe, especially on an exterior wall, strongly suggests such a structural moisture source. However, if the cause is solely attributed to tenant behavior—like failing to run the AC adequately or overcrowding the closet without ventilation—the responsibility could fall on you.

Your first step is to formally notify your landlord in writing with photos of the mold and damaged belongings. They should arrange for a professional inspection to diagnose the exact moisture source. This is critical, as surface cleaning without fixing the underlying problem is futile. A proper assessment can determine if the wall has a leak or if the AC system is not effectively managing the room's humidity.

Regarding your belongings, the landlord's obligation to replace them is usually tied to their liability for the underlying defect. If the inspection proves the moisture is from a structural failure, they should cover the cost of remediation and compensation. If the cause is deemed to be lack of ventilation, you may be responsible.

Given the location on an exterior wall in a Jumeirah villa, a latent construction issue is a strong possibility. Document everything and insist on a professional diagnosis to establish liability. Do not attempt to clean it yourself, as disturbing extensive mold without containment can spread spores throughout your home.
