Is landlord responsible for mold in Discovery Gardens apartment?« Back to Previous Page

Our bedroom closet on the outside wall has started to feel damp, and we just found a patch of black mold on the back wall behind our clothes. We've been in this Discovery Gardens apartment for about a year and it was fine, but it’s gotten worse since the humidity spiked. Is getting a mold inspection the landlord's responsibility to fix, or is this on me as the tenant?

Landlord responsibility for mold in Dubai depends on the source of the moisture. Under standard tenancy contracts, the landlord is responsible for the structural integrity of the property. If the dampness is due to a leak in the external wall, faulty waterproofing, or a broken pipe within the building structure, the remediation is their obligation.

However, if the moisture is a result of tenant behavior—such as inadequate ventilation, drying clothes indoors, or failing to use the AC to manage humidity—then the tenant may be liable for the resulting damage. In your case, the location on an outside wall in Discovery Gardens, a known area for high humidity, strongly suggests an infiltration or condensation issue related to the building envelope, which is typically the landlord's responsibility.

Given the climate, this is a serious case. The persistent dampness and visible growth warrant a professional inspection to identify the exact moisture source. An inspection will provide documented evidence of the cause, which is essential for formally requesting repairs from your landlord or building management. They can determine if the issue is a penetrating leak from outside or condensation due to poor insulation, both of which are structural.

Start by notifying your landlord in writing with photos. If they are unresponsive, a professional report from a company with a microbiology lab can provide the necessary evidence to escalate the matter, if needed, through Dubai's Rental Dispute Center.
