Is landlord responsible for mold cleanup in rental?« Back to Previous Page

My kids have been coughing for the past month and I finally pulled out their dresser in our bedroom in Silicon Oasis to find a huge patch of black mold on the wall behind it. The AC unit is on that same wall and I think the condensation might be the cause. Is this something I need to fix myself, or is the landlord legally responsible for the cleanup and repainting?

Under Dubai's rental law, the responsibility for mold remediation depends on the cause. The landlord is generally responsible for fixing the structural or maintenance issue that led to the moisture, such as a leaking pipe, faulty AC drainage, or inadequate insulation. The tenant is typically responsible for damage caused by their own negligence, like failing to use the AC or ventilate the property properly.

Given your situation in Silicon Oasis, the AC condensation leak is a strong indicator of a maintenance issue with the unit's drainage system, which falls under the landlord's purview. The year-round AC use in Dubai's climate makes clogged drain lines and condensation leaks a common source of hidden moisture.

Your first step is to formally notify your landlord or property management company in writing, with clear photos of the mold and the AC unit. They are obligated to address the source of the water intrusion. For a patch you describe as "huge," a professional inspection is wise to assess the full extent and identify the mold species, as some types require specific remediation protocols.

Do not attempt to clean significant mold growth yourself with bleach, as this can aggravate spores and doesn't address the moisture source. The landlord should arrange for proper remediation to remove the mold safely and repair the wall, including repainting with mold-resistant paint after it is completely dry. If the landlord refuses to act, you can file a complaint with the Rental Dispute Center (RDC) in Dubai.
