Who is responsible for AC mold under UAE tenancy law?« Back to Previous Page

My kids have been coughing and I suspect it might be from black mold that's grown around the edges of our bedroom AC vents. We've lived in this Mirdif apartment for 2 years and just noticed it getting worse this past humid season. I've reported it to the landlord, but they say it's our responsibility to clean it. Who is actually responsible for treating this under UAE tenancy law, the tenant or the owner?

Under Dubai Law No. 26 of 2007 (as amended), the general rule is that the landlord is responsible for maintaining the structural parts of the property, including the central air conditioning system and its main ducts. The tenant is typically responsible for minor maintenance and cleaning inside the apartment.
The mold on your AC vents is likely due to condensation from the unit's operation, a very common issue in Dubai's humid climate where AC runs year-round. This specific situation creates a gray area. While the landlord is responsible for the AC unit itself and ensuring it functions, the surface mold on the vent covers could be argued as a cleaning issue. Your first step is to formally notify the landlord in writing (email is best), citing the visible mold and your health concerns. Clearly state that the mold appears to be a result of the AC unit's operation and potential condensation issues within the system, which falls under their maintenance responsibility. Mention that your children's coughing coincides with its presence. If they refuse, you can file a complaint with the Rental Dispute Center (RDC) in Dubai. They will often side with the tenant on health-related maintenance issues, especially when a landlord is unresponsive. For your family's health, consider a professional mold inspection to confirm the type and source. This provides documented evidence if a dispute escalates, showing whether the mold is a superficial issue or originates from within the AC system itself, which is unequivocally the landlord's duty to remediate. |
