Is landlord responsible for hidden mold in rental apartment?« Back to Previous Page

We've lived in our Jumeirah apartment for 2 years and just noticed a huge patch of black mold spreading on the wall behind our wardrobe, which must have been hidden for ages. The dehumidifier runs constantly but the room still feels damp. As a tenant, am I responsible for paying the full cost of professional mold removal, or is this something the landlord has to handle since it's a structural issue?

In Dubai, the responsibility for mold remediation depends on the cause. If the mold is due to a structural issue like a hidden water leak from plumbing or a faulty AC drain line within the building, the landlord is typically responsible for the repair and the resulting mold removal. However, if the cause is tenant-related, such as inadequate ventilation or failure to use the AC, the tenant may be liable.

Your situation suggests a structural problem. The constant dampness and mold growth behind fixed furniture, despite using a dehumidifier, points to an internal leak or condensation issue within the wall. This is a common problem in Dubai's climate, where high humidity and year-round AC use can lead to concealed condensation if insulation or drainage is faulty.

Your first step is to formally notify your landlord or property management company in writing, with photos, and request an immediate inspection. Do not attempt to remove it yourself, as disturbing large patches can aerosolize spores. A professional inspection is crucial to identify the moisture source definitively; this is often the key evidence needed to determine responsibility. The inspection report will document whether the cause is a maintenance issue (landlord's duty) or a lifestyle issue (tenant's duty).

For verifiable remediation, the process should involve identifying and fixing the water source, then properly containing and removing the mold, not just wiping it down. The landlord should arrange for a qualified service to handle this.
