Is landlord responsible for black mold removal as tenant?« Back to Previous Page

My kids have been coughing and I suspect it's from this black, fuzzy mold that's been spreading on the bedroom wall behind the wardrobe for the last couple of months. We're in a villa in Mirdif and the wall always feels slightly damp, especially after running the AC. As a tenant, am I responsible for getting this cleaned and treated, or is this something I need to urgently report to my landlord to fix?

The landlord is typically responsible for treating black mold, as it's considered a structural issue related to moisture intrusion or faulty AC systems, which fall under their maintenance obligations. Tenants are generally responsible for reporting the issue promptly and maintaining good ventilation.

Under Dubai rental law (Law No. 26 of 2007), landlords must ensure the property is habitable and maintain the structure, including walls and installed AC units. The persistent dampness you describe, especially if it's due to a leak, poor insulation, or a malfunctioning AC causing condensation, is their responsibility to rectify.

You should urgently report this in writing to your landlord or property manager, including photos of the mold and the damp wall. The combination of Dubai's high humidity and continuous AC use can cause condensation inside walls if there's a temperature differential or insulation flaw, creating a perfect environment for mold.

For your family's health, it is advisable to request a professional inspection. While not all black mold is the notorious Stachybotrys, any persistent mold can cause respiratory irritation, coughing, and worsened allergies, particularly in children. A proper assessment can identify the moisture source and mold species, which guides the correct remediation method—simply wiping it away is insufficient if the dampness remains. Keep a record of all communications with the landlord regarding this health and safety concern.
