Who is responsible for AC leak and black mold in rental?« Back to Previous Page

The AC in my bedroom has been leaking a bit for the last few months, and now I’m seeing these black, speckled patches spreading on the wall behind the headboard. I’ve been getting terrible headaches and my landlord is saying it’s not a big deal and just to wipe it off. Who is legally responsible for getting this properly tested and cleaned in a rental here?

Under Dubai rental law (Law No. 26 of 2007), the landlord is responsible for maintaining the property's structure and core systems, which includes the fixed air conditioning unit and any resulting water damage or mold growth from its malfunction. An AC leak is a maintenance issue they must address.

Your situation with recurring headaches and visible black, speckled growth is a serious health concern that goes beyond simple staining. The persistent humidity from the leak creates a perfect environment for mold, which is common here. Merely wiping it is ineffective and can aerosolize spores, potentially worsening symptoms.

You should formally notify your landlord in writing (email is best) about the AC leak and mold, clearly stating its impact on your health. Request immediate repairs to the AC unit and professional mold remediation for the wall. Keep records of all communication.

If they refuse, you can file a complaint with the Rental Dispute Settlement Center (RDSC) in Dubai. For your health and to document the issue, a professional inspection and lab test can identify the mold species and the extent of the problem, providing concrete evidence if a dispute arises. This is not a cosmetic issue; it's an indoor air quality and tenant health matter.
