My kids have been coughing for the last month, and I finally pulled the sofa away from the wall in our Deira apartment to find a huge patch of black mold growing behind it, probably from a hidden leak. I’ve told my landlord, but he says it’s our fault for not ventilating the room properly. We keep the AC on constantly, but the wall itself feels damp. Who is legally responsible for arranging and paying for a professional mold inspection in this case?

The landlord is typically responsible for structural issues like hidden leaks, which is the likely cause of dampness in the wall. Dubai's high humidity and constant AC use can cause condensation, but that usually results in surface mold on cold walls, not sustained dampness within the structure itself. A hidden pipe leak is a building maintenance issue.

Under UAE tenancy law, the landlord is obligated to maintain the property in a habitable condition. A significant mold outbreak from a concealed leak that is damaging the structure falls under this obligation. Document everything: take clear photos of the mold and the damp wall, and keep all communication with your landlord in writing (email or WhatsApp is best).

For a case of this size and with health symptoms present, a professional inspection is strongly advised to identify the moisture source and mold type. The inspection cost is often negotiated, but the responsibility for the underlying repair and remediation lies with the landlord. You can propose splitting the initial inspection cost to get a definitive report on the cause. If the landlord remains uncooperative, you can file a complaint with the Dubai Land Department's Rental Dispute Center (RDC).
