Who is responsible for AC mold inspection, tenant or landlord?« Back to Previous Page

The AC in our apartment in Jumeirah Village Circle has been making us sick for a couple of months, and I finally pulled the vent cover to find black mold all inside the unit. Our landlord is saying regular AC maintenance is our job as tenants, but I think this is a pre-existing issue with the ducting. Who is legally responsible for arranging and paying for a proper mold inspection in this case, the tenant or the landlord?

In Dubai, the responsibility for AC maintenance and mold inspection typically falls on the landlord for issues inherent to the property's structure and fixed systems, which includes the main AC unit and internal ducting. As a tenant, you are generally responsible for routine filter cleaning and basic upkeep. The black mold growth you've discovered inside the unit and ducting strongly suggests a systemic issue, likely caused by chronic condensation due to high humidity, a poorly insulated duct, or a drainage problem within the AC system itself—all of which are the landlord's responsibility to rectify.

Your first step should be to formally notify your landlord in writing, with photos as evidence, that a potential health hazard exists due to the property's AC system. Mention that the mold is pervasive and not a result of simple filter neglect. For a case this severe, a professional inspection is critical to determine the full extent of contamination and the underlying moisture source. The resulting lab report from a certified inspector will serve as definitive proof of the problem's severity and origin, which is essential for your discussion with the landlord.

If the landlord remains uncooperative, you can reference the rental law which mandates the landlord must maintain the property in a habitable condition. Escalation paths include filing a complaint with the Rental Dispute Settlement Center in Dubai. Given the climate and the health symptoms you're experiencing, do not delay; this requires professional assessment to identify the mold species and create a proper remediation plan.
