Who is responsible for mold from a leaking AC rental?« Back to Previous Page

The AC in my bedroom closet has been leaking for a while, and now I've found a huge patch of black mold on the back wall and on some of our stored suitcases. We're in a rental apartment in Jumeirah Village Circle and our contract is up for renewal next month. The landlord is saying it's our fault for not maintaining the AC, but we get it serviced annually. Who is legally responsible for the cost of the mold removal and repairing the wall in this situation?

The landlord is typically responsible for fixing the leaking AC unit and the resulting structural damage to the wall, as these are considered maintenance issues for the property's permanent fixtures. Under standard Dubai rental law (RERA), landlords must maintain the property in a habitable condition, which includes the repair of AC systems that are part of the building.
Your responsibility as a tenant is generally limited to reporting issues in a timely manner and maintaining the unit through regular servicing, which you have done. The annual servicing you mentioned is for the internal unit and filters, not for fixing mechanical leaks. The leak itself is a failure of the equipment or its installation, which falls under the landlord's purview. Document everything: take clear photos of the mold, the leak, and your AC service receipts. For a case of this apparent size, a professional inspection is strongly advised to assess the full extent behind the wall. In Dubai's high humidity, mold from an AC leak can spread quickly into gypsum board and insulation. Present your evidence and the inspector's report to the landlord. If they remain uncooperative, you can file a formal complaint with the Rental Dispute Center (RDC) in Dubai. Do not proceed with remediation until liability is established, as unauthorized work could complicate your case. |
