Is AC leak mold remediation landlord or tenant responsibility?« Back to Previous Page

The AC in my apartment seems to be constantly leaking, and now I’m seeing black spots spreading on the wall behind my bedroom wardrobe in Jumeirah Lakes Towers. It’s been getting worse since the humidity spiked a few weeks ago. My landlord is saying it’s our fault for not ventilating properly, but the leak is clearly from the AC unit itself. Are we responsible for paying the mold inspection and remediation, or is this the landlord's obligation to fix?

This is a common point of contention in Dubai rentals. The responsibility typically depends on the source of the problem. Since the leak is from the AC unit itself, which is a fixture and part of the property, this is almost certainly the landlord's responsibility to repair. The resulting mold growth is a direct consequence of that unrepaired leak.

Under typical Dubai rental laws (RERA), landlords are obligated to maintain the property's structure and key systems, including air conditioning. Tenants are responsible for damage they cause through negligence, but a faulty AC unit is not tenant negligence. Your documentation is key: take clear photos and videos of the leak originating from the AC unit and the subsequent mold growth. Formally notify your landlord in writing (email is best for a paper trail) about the issue and request immediate repairs.

Given the climate, with high humidity causing condensation issues year-round, AC leaks are a frequent cause of hidden mold in JLT and similar buildings. The black spots spreading behind the wardrobe indicate an active problem that requires professional inspection. A proper assessment will identify the mold type and moisture source, which is essential evidence for your landlord. For a case this advanced, a certified inspection with lab analysis of the mold species provides a definitive report to present to the property owner.
