Is landlord responsible for black mold removal costs?« Back to Previous Page

My kids have been coughing and I suspect it’s from the black mold I just found spreading along the wall behind our wardrobe in the master bedroom. It’s been getting worse since the humidity spiked a couple of weeks ago. We’ve been in this Jumeirah Village Triangle apartment for a year and never had an issue before.
Am I responsible for the mold removal costs, or is this something my landlord has to fix as part of building maintenance?

Under UAE law, the responsibility for mold removal hinges on the cause of the moisture. The landlord is obligated to maintain the property's structure and ensure it is habitable. This includes fixing leaks from external walls, internal plumbing within the building, or faulty AC units that cause condensation. If the mold behind your wardrobe is due to a pre-existing structural leak or inadequate waterproofing, the repair and remediation cost falls to the landlord.
However, tenant responsibilities include maintaining adequate ventilation to prevent humidity buildup, which is a major catalyst for mold in Dubai's climate. If the mold is determined to be solely from condensation due to a lack of AC use or keeping windows closed, you could be held responsible for the cleaning. Given that the mold is spreading and your children are experiencing health symptoms, your first step is to formally notify your landlord or property management company in writing, with photos. Request an immediate inspection to identify the moisture source. Do not attempt to clean significant black mold yourself, as improper disturbance can aerosolize spores. A professional assessment is critical to determine the root cause; reputable inspectors use moisture meters and thermal cameras to pinpoint hidden leaks. This documented evidence is what will definitively assign financial responsibility. For health safety, prioritize identifying the species through lab testing, as some types of black mold (like Stachybotrys) require more stringent containment protocols during removal. |
