Who pays for black mold cleanup in rental property?« Back to Previous Page

My kids have been coughing and I suspect it might be from the black mold that’s been slowly spreading along the corner of our master bedroom ceiling in our JVC villa. It started as a small patch after the heavy rains in February but has definitely gotten bigger and darker over the last month. We’ve been renting this place for three years and never had an issue before. Am I responsible for the cleanup and cost, or is this something the landlord has to handle because it could be a leak in the building?

The responsibility for mold cleanup in a rental property depends on the cause. In Dubai, if the mold is due to a structural issue, like a roof leak or faulty external waterproofing, the landlord is typically responsible for the repair and resulting remediation. However, if the mold is caused by tenant behavior, such as inadequate ventilation leading to condensation, the tenant may be liable.
Given your description, the timing after heavy rains strongly suggests an external water intrusion, which is a building issue. The first step is to formally notify your landlord or property management company in writing, with photos showing the progression. They are obligated to address the source of the moisture under UAE tenancy law, as it affects the habitability of the property. For health concerns, especially with children coughing, identifying the mold type is prudent. While often called "black mold," many dark-colored species exist. Only a professional inspection and lab analysis can confirm the specific type and its potential for producing irritants. The Dubai climate, with its high humidity and year-round AC use, creates perfect conditions for mold to flourish from any small, unrepaired leak. Do not attempt to clean it yourself, as disturbing it can release spores. The landlord should arrange for a leak detection specialist to find the source and a qualified remediation company to safely remove it, following the diagnostic results. |
