Who is responsible for black mold cleanup and costs?« Back to Previous Page

We've been in our Jumeirah Village Circle apartment for two years and just noticed a patch of black mold spreading in the corner of the master bedroom closet where we store our winter clothes. It seems to have gotten much worse since the recent humid weather. Who is responsible for the cleanup and cost of replacing our damaged items, us or the landlord?

The responsibility depends on the source of the moisture causing the mold. In Dubai's humid climate, mold in a closet often stems from condensation due to a nearby AC unit's cold surface or a leak in the building envelope.

Under UAE tenancy law (Law No. 26 of 2007), landlords are responsible for maintaining the structural integrity of the property. If the mold is caused by a structural issue like a leaking pipe, faulty external waterproofing, or an inherent AC drainage problem, the landlord is typically responsible for the remediation and repair of the property itself. However, tenants are responsible for damage resulting from their own negligence, such as failing to use the AC to control humidity or blocking ventilation.

For your situation in JVC, the location suggests a potential condensation issue from the adjacent wall or a hidden AC duct leak. Your first step is to formally notify your landlord or property management company in writing with clear photos. They should arrange for a professional inspection to identify the moisture source. Do not attempt to clean it yourself with bleach, as this can worsen airborne spores and fails to address the root cause.

Regarding damaged personal items, liability is less clear-cut and often depends on the lease agreement and the proven cause of the mold. If the landlord's failure to maintain the property is the cause, you may have a claim for compensation. Document everything with photos and keep records of all communication. For a definitive assessment of the mold type and source, a professional inspection with moisture mapping and, if necessary, lab analysis is the most reliable course of action.
